Terms of Service

These terms apply when you use beonline.nz or buy a product through it. Please read the section on the reseller platform and the section on liability in particular — they explain who is responsible for what.
Who you are contracting with
This website is operated by Be Digital Limited, a New Zealand company, trading as Be Online. Using the site means you accept these terms. If you do not accept them, please do not use the site.
Products are provisioned through an authorised reseller platform
Be clear on how this works, because it affects your rights.
Domains, hosting, professional email, Microsoft 365, SSL certificates and website security sold here are provisioned through our authorised reseller platform. We select, price and support these products, and we are your point of contact. The underlying service is delivered on that provider’s infrastructure, and your order is completed and managed on their secure checkout and customer portal.
When you buy, you are also accepting the product provider’s own terms of service for that product, together with any registry rules that apply to a domain name. Where their terms and these terms conflict on a matter specific to the product itself, theirs apply to that product.
We do not control that provider’s infrastructure, uptime or maintenance windows, and we cannot guarantee them.
Prices, GST and payment
Prices on this website are in New Zealand dollars and exclude GST unless clearly stated otherwise. GST is added at checkout where it applies. Prices for international extensions may also attract ICANN fees, which are shown at checkout.
Prices shown on the website are read from our live registration system, but the price that applies to your order is the price confirmed at checkout. Introductory pricing applies to the first term only; renewals are charged at the standard rate current at the time of renewal.
If a price is displayed that is obviously wrong — a clear pricing or typographical error — we may decline or cancel the order rather than supply at that price. If you have already paid, we will refund you in full.
Renewals
Domains, hosting and subscription products renew automatically unless you turn renewal off. This is deliberate: a lapsed domain can take your website and email down, and may be registered by somebody else. We will notify you before a renewal is charged. You can turn auto-renewal off at any time in your account.
Domain names
- A domain search result is an indication of availability at that moment. A name is only yours once registration is confirmed.
- You are responsible for the accuracy of your registrant contact details, and for keeping the registrant email address one you can actually read.
- .nz domains are subject to the policies of the Domain Name Commission. International extensions are subject to ICANN policy, including the Uniform Domain-Name Dispute-Resolution Policy.
- You must not register or use a domain name that infringes someone else’s trade mark or other rights.
Your responsibilities
You agree to keep your account credentials secure, to give us accurate information, and not to use our services to send spam, host unlawful material, infringe copyright or trade marks, or attack other systems. We may suspend a service where it is being used unlawfully or where it threatens the stability or security of the platform. Where it is reasonable to do so, we will contact you first.
Consumer rights
If you are a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you rights that these terms do not limit or exclude. Nothing here is intended to affect those rights.
Where you acquire our services for the purposes of a business, you and we agree that the Consumer Guarantees Act does not apply, to the extent permitted by section 43 of that Act.
Liability
We take our work seriously, but there are limits to what we can reasonably carry.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data. Where we are found liable, our total liability for any claim is limited to the amount you paid us for the service the claim relates to in the 12 months before the claim arose.
Nothing in this section limits liability that cannot be limited by law, including under the Consumer Guarantees Act where it applies to you.
You are responsible for keeping your own backups. Backup products we sell reduce risk; they do not remove your responsibility for your own data.
Cancellation and refunds
Refund eligibility depends on the product and is governed by the product provider’s refund policy, which is shown at checkout. As a general rule, domain registrations are not refundable once the name has been registered, because the registry fee has already been paid. Subscription products may be refundable within a short window from purchase.
If something is faulty or not as described, contact us — your rights under the Consumer Guarantees Act are unaffected by any refund policy.

We may update these terms. The date at the top of this page shows when they last changed, and material changes will be signalled on the website. Continuing to use the site after a change means you accept the updated terms.
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. Before anything formal, please contact us — most issues are resolved with a phone call.
